1. Acceptance of Terms

By accessing or using SmartFeed ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We record the date on which you accept these Terms (and any subsequent material revisions) and may show that record to you in your account.

2. Description of Service

SmartFeed is a mobile news aggregation and AI-powered summarisation service available as native apps on iOS (App Store) and Android (Google Play). The smartfeed.live website is informational only.

The Service includes:

• Curated news from public RSS feeds, organised into four daily time blocks (Morning, Midday, Afternoon, Evening)
• AI-generated article summaries, translations into your selected language, and audio narration
• An in-app conversational AI that answers questions about individual articles
• Saved articles, tracked subjects, and podcast subscriptions
• Personal "Your Focus" statistics

3. Eligibility

You must be at least 16 years old to use the Service. By accepting these Terms, you confirm that you are 16 or older. If we learn that we have collected personal data from a user under 16, we will delete that data without undue delay.

4. User Accounts

• To use SmartFeed, you must create an account using Sign in with Apple or Sign in with Google. There is no email/password sign-in.
• Authentication is delegated to Apple or Google. You are responsible for maintaining the security of your underlying Apple ID or Google account.
• You must provide accurate information and not impersonate another person.
• You may not share your account or create multiple accounts to circumvent subscription limits.
• You can delete your account at any time from Profile → Account → Delete Account. All personal data is permanently deleted within 7 days.

5. Subscription

SmartFeed is a premium subscription service. There is no free tier and no perpetual free access.

Free Trial

• New users receive a 7-day free trial of premium access on first sign-up.
• Billing begins automatically at the end of the trial unless you cancel before the trial ends.
• You will be reminded by your platform store before the trial converts to a paid subscription.

Plans and Pricing

• Monthly: €4.99 per month (or local equivalent set by Apple/Google)
• Annual: €49.99 per year (~17% saving vs monthly)

Final pricing in your local currency is determined by Apple or Google at purchase time and may differ from the European reference price above.

Billing and Cancellation

• Payment will be charged to your Apple ID or Google account at confirmation of purchase.
• Subscriptions automatically renew at the same price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Billing is processed by Apple App Store (on iOS) or Google Play (on Android) under their respective terms. SmartFeed never has access to your payment method or billing details.
• Cancellation must be done in your platform's subscription settings (Settings → Apple ID → Subscriptions on iOS, or Play Store → Subscriptions on Android). The SmartFeed app provides a "Manage Subscription" link that opens the relevant settings page.
• Refunds are governed by Apple's and Google's refund policies. SmartFeed cannot directly issue refunds.

Consent to Immediate Performance — Waiver of 14-Day Withdrawal Right

Under EU Directive 2011/83/EU, consumers ordinarily have a 14-day right to withdraw from a contract for digital content. By starting your free trial or purchasing a SmartFeed subscription, you expressly request that the Service be provided to you immediately and you acknowledge that you thereby lose your right of withdrawal once performance has begun. This consent is captured at the point of purchase along with your acceptance of these Terms.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorised access to the Service, its servers, or other users' accounts
• Interfere with or disrupt the Service or its underlying infrastructure
• Use automated systems (bots, scrapers, scripts) to access the Service without our express permission
• Resell, redistribute, or publicly display Service content without authorisation
• Use the Service to infringe on intellectual property rights
• Reverse-engineer, decompile, or attempt to derive the source code of the SmartFeed apps

7. Content

Third-Party Content

SmartFeed aggregates and summarises content from third-party news sources. We do not claim ownership of this content. All original content remains the property of its respective publishers and copyright holders. We provide attribution and a link to the original article wherever possible.

AI-Generated Content

Article summaries, translations, audio narrations, and conversational answers are generated by artificial intelligence ("AI Output"). You acknowledge and agree that:

• AI Output may contain factual inaccuracies, omissions, fabrications, or out-of-date information, including with respect to real persons, organisations, places, or events.
• SmartFeed does not endorse, verify, or guarantee the accuracy of AI Output and makes no representation or warranty about its truthfulness, completeness, or fitness for any purpose.
• AI Output is provided for informational and convenience purposes only and must not be relied upon as the sole basis for any decision, particularly decisions of a medical, financial, legal, professional, journalistic, or otherwise material nature.
• You use AI Output at your own risk. You agree to verify any important information against the original source and to consult qualified professionals where appropriate.
• You agree to indemnify and hold harmless SmartFeed against any claim, loss, or damage arising from your reliance on, sharing of, or republication of AI Output, including any claim by a third party (for example, for defamation, misrepresentation, or infringement) based on AI Output that originated within the Service.

8. Intellectual Property

The SmartFeed apps, the smartfeed.live website, and the SmartFeed brand and design are owned by SC Smart Continuous Development SRL. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE. OUR TOTAL LIABILITY FOR ANY DIRECT DAMAGES IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability which cannot lawfully be excluded or limited under applicable mandatory law, including mandatory consumer protection law in your country of residence.

11. Indemnification

You agree to indemnify and hold harmless SC Smart Continuous Development SRL and its operators from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your reliance on AI Output as described in Section 7.

12. Force Majeure

Neither party shall be liable for any failure or delay in performance that is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, governmental action, labour disputes, internet or telecommunications failures, outages or disruptions of third-party providers (including Apple, Google, Supabase, Vercel, Google Cloud, RevenueCat, or Upstash), or cyberattacks.

13. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes when possible. If we discontinue the Service entirely, we will refund any prepaid amounts for periods after the discontinuation date, in coordination with Apple or Google.

14. Modifications to Terms

We may update these Terms from time to time. Each version is identified by the "Version" string at the top of this page. If we make material changes, we will require you to review and re-accept the updated Terms inside the app before you can continue using the Service. Non-material changes (typos, clarifications, formatting) may be applied without a re-acceptance prompt, with the "Last updated" date refreshed accordingly. The date and version of your acceptance are stored in your account.

15. Termination

We may suspend or terminate your access to the Service at any time for material violation of these Terms, or for legal or operational reasons. You may terminate your account at any time via the in-app account deletion flow.

16. Reporting Illegal Content (EU Digital Services Act)

In accordance with Article 16 of Regulation (EU) 2022/2065 (Digital Services Act), if you become aware of content delivered through the Service that you believe is illegal under applicable EU or national law — for example, defamatory statements, content infringing your intellectual property rights, or content otherwise prohibited by law — you may submit a notice to us by email at feedback@smartfeed.live with the subject line "Illegal content notice." Please include:

• Your name and contact information (so we can confirm receipt and follow up)
• A precise description of the content (for example article ID, screenshot, or AI summary text)
• The reason you believe the content is illegal, with reference to the applicable law where possible
• A statement that the information provided is accurate and complete to the best of your knowledge

We will acknowledge receipt and act on substantiated notices without undue delay.

17. Data Protection

Personal data processed in connection with the Service is handled in accordance with our Privacy Policy, which forms an integral part of these Terms. The data controller is SC Smart Continuous Development SRL.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania. Any disputes shall be resolved in the competent courts of Cluj-Napoca, Romania, except where mandatory consumer protection law in your country of residence requires otherwise. EU consumers retain the right to bring proceedings in their country of habitual residence as provided by Regulation (EU) 1215/2012.
